Who Owns SK Foods, L.P. Remnant Assets?
Oak Point Partners acquired the remnant assets of the SK Foods Liquidating Trust (SK Foods) in June 2020.
On May 7, 2009, involuntary petitions for relief were filed against SK Foods, L.P. and RHM Industrial/Specialty Foods, Inc. d/b/a Colusa County Canning Co. under chapter 11 of the Bankruptcy Code in the United States Bankruptcy Court for the Eastern District of California, assigned Case Nos. 09-28956 and 09-28955, respectively. On May 18, 2009, the Court entered orders appointing a chapter 11 trustee of Initial Debtors' bankruptcy estates. On June 18, 2009, the Court entered orders consolidating the Involuntary Cases and the Voluntary Cases under Case Nos. 09-29161 and 09-29162. On July 15, 2010, the Court entered an order substantively consolidating Initial Debtors' bankruptcy estates under Case No. 09-29162. In December 2011, the Court entered an order, as further amended, in a related adversary proceeding, Case No. 10-02014 appointing a Receiver for various non-debtor affiliates of Initial Debtors. On October 4, 2013, the Court entered a judgment in the Adversary Proceeding substantively consolidating the Affiliates with the Initial Debtors and thereby deeming all assets of the Affiliates to be property of the Consolidated Estate and vesting the Chapter 11 Trustee with the power and duty to administer such assets.
