On November 17, 2006, M. Fabrikant & Sons, Inc. and its related entities (“Fabrikant”) filed a chapter 11 petition in the United States Bankruptcy Court for the Southern District of New York, assigned jointly administered case No. 06-12737. Fabrikant confirmed a chapter 11 liquidating plan, which transferred the assets to a Trust and appointed a Trustee to liquidate Fabrikant for the benefit of creditors.
