On August 4, 2011, Lyman Holding and its affiliates filed voluntary petitions for relief under chapter 11 of the Bankruptcy Code in the United States Bankruptcy Court for the District of Minnesota, jointly administered under Case No. 11-45190. On February 28, 2013, the Court entered an order confirming the Debtors’ Second Amended Joint Chapter 11 Plan of Liquidation, pursuant to which the Liquidating Fund was created and the Liquidating Agent was appointed and vested with the power and duty to administer the Liquidation Fund and the remaining assets of the Debtors.
