Who Owns Appalachian Fuels, LLC Remnant Assets?
Oak Point Partners acquired the remnant assets of the Appalachian Fuels Creditors Trust (Appalachian Fuels) in April 2018.
On June 11, 2009, an involuntary petition was filed against Appalachian Fuels under chapter 7 of the Bankruptcy Code in the United States Bankruptcy Court for the Eastern District of Kentucky, Case No. 09-10343, which case was converted to chapter 11 and jointly administered with the bankruptcy cases of affiliated entities. On or about December 19, 2011, the Court entered an order confirming a plan, jointly proposed by Appalachian Fuels, LLC and the Official Committees of Unsecured Creditors for Appalachian Fuel and Appalachian Premium Fuels, pursuant to which the Trust was established and the Liquidating Trustee was vested with the power and duty to administer the remaining assets of the Debtors.

Appalachian Fuels was a coal mining operator in Kentucky and West Virginia. The company produced and sold coal for electric utilities and coking coal plants. With many factories using less and less electricity, as well as the automotive industry producing less cars, the demand for coal left Appalachian Fuels as the culprit of an economic domino effect. At its peak, the company employed 400 people and operated six mines.
Appalachian Fuels also operated under several trade names including Appalachian Coal Holdings, Inc., Appalachian Environmental, LLC, Kanawha Development Corporation, and Southern Eagle Energy, LLC.
