Trustees often sue to recover certain payments made prior to the bankruptcy filing as preference payments. Typically a portion of the preference suits become default judgments against the defendants. Oak Point works with the bankruptcy trustee to turn these default judgments into liquid assets on behalf of the bankruptcy estate by executing a purchase transaction. Over the past few years, Oak Point has completed over 50 transactions involving preference defaults, helping Trustees and Plan Administrators to monetize batches of non-performing judgments. We are willing to either purchase portfolios outright for cash upfront or work them on a contingency basis where we keep a percentage of the recovery. In either case, we handle all claims very professionally via CW Recovery, the commercial collection agency owned by Oak Points principals. |
